Terms and Conditions for Buying a Horse from GTS
PRICE: Our horses range in price from $15,000 to $25,000, with an occasional horse under or over that amount. Serious buyers can schedule time to come to our private ranch and try out several horses that might fit your bill; we will only show you horses that we believe are perfect for you. VIEWING HORSES: You may schedule a viewing of any horse/s we feel suits your needs by calling or emailing us. Although horses may also be purchased sight unseen, we encourage you to come visit the horse/s in person and try them out on our ranch, working with us to determine the suitability of the horse to you. PAYMENT: Payment must be made in full at time of purchase. We accept cash, cashier’s check, traveler’s checks and personal checks. We accept credit cards with a 3% surcharge (Visa/ MC/ AmEx). Buyer assumes all risks and expense of horse immediately upon purchase. All payments must be made in US Dollars.
DEPOSITS: Horses are sold on a first-come, first-served basis. If you wish to place a deposit on a horse in order to have first option to buy, you may do and we will hold the horse for up to 30 days, to allow you the opportunity to look at the horse. A $1,000.00 non-refundable deposit is required to hold any horse, if there is not a sale pending on the horse. To place an immediate hold on an available horse, you may call our office at (800) 225-8827 and use a credit card.
BILL OF SALE/BRAND PAPERS: See a blank copy of our purchase agreement by clicking here . All horses purchased at our farm will have a Colorado State Brand Inspection, as required by Colorado law. This is your official title to the horse; like your car title, it is registered by the state.
REGISTRATION PAPERS: We will make a transfer of ownership for all AQHA registered horses and the papers will be sent by AQHA to the buyer. For all other registries, buyer will make the transfer of ownership directly with the registry if desired. Buyers shall be responsible for any and all registration fees. Registration papers will be released when your payment clears our bank.
TRANSPORTATION: We will be glad to assist you in setting up transportation throughout the country or overseas for your horse(s). We will also be glad to board your horse(s) until transportation can be arranged. Board is $15.00 per night.
COGGINS AND HEALTH CERTIFICATES: All horses will have current twelve month Coggins test for Equine Infectious Anemia and a current health certificate for interstate transporting.
HEALTH AND VET EXAM: We strive to deal only in healthy, fit and sound horses. Horses have been examined fully by our farm vet, prior to being offered for sale. All horses are in excellent health with no known health or soundness issues; any known history of illness, blemish, vice or unsoundness, if any, will be fully disclosed prior to purchase. We maintain our horse’s health maintenance to a very high standard; all horses are current on vaccines (as indicated in our area), deworming, farrier and are supplemented with Cosequin® (glucosamine and MSN). You may have one of three local vets conduct an exam prior to purchase and we will assist you in that effort if required. A veterinarian of your choice may be brought in for evaluation, or we can trailer the horse to a vet clinic of your choosing at your expense. Horses are not released from our possession until a sale is consummated.
LIMITED WARRANTIES: Buyers should fully satisfy themselves concerning the condition of any horse purchased from us or any other seller. All sales are final. We represent that the horses we offer for sale are, at the time of sale, unless stated otherwise:
- The horse is sound of limb, eyes and wind.
- The horse is free of any lameness or unsoundness to our best knowledge
- The horse has not been de-nerved or treated for navicular disease or laminitis
- The horse does not have any known behavior problems or vices and is not a ‘cribber’
- The horse is not cold-backed or cinchy
- The horse stands tied and trailer loads
Such warranty and guarantee to be in effect at time of purchase and for three days after purchase. If it is determined by seller that horse does indeed possess any unsound condition which is the result of a pre-existing condition prior to sale, seller agrees to accept the horse back as unsold, with the cost of transporting said horse back to seller to be borne by the buyer.
LIABILITY: Potential buyers, their families and associates visiting our facility do so at their own risk, according to CO Statute 13-21-120. WARNING: Under Colorado Law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-120, Colorado Revised Statutes. Neither the sellers nor any person connected with Goodnight Training Stables, Inc., assume any liability, legal or otherwise, for accidents to persons or property before, during or after the inspection of horses for sale on our premises. |
